Terms of Use

The short version: be kind to the app and to Norbot, treat the AI's gardening tips as friendly suggestions rather than professional advice, and know that the optional AI subscription renews automatically until you cancel it in your device's app store settings.

These Terms of Use ("Terms") govern your use of the niftynorbot.com website and the Nifty Norbot mobile application (collectively, the "Service"), operated by Nifty Norbot ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Nifty Norbot is a garden-care companion app. It lets you track your plants, keep garden notes, receive watering reminders and local weather information, and — with an active subscription — use AI-powered features including personalized gardening advice, garden chat, and photo-based plant identification.

2. Your Account

You need an account to use the Service. You agree to provide accurate information when registering and to keep your credentials secure. You are responsible for all activity that occurs under your account. You must be at least 13 years old to use the Service.

You can delete your account at any time from the app's Settings screen. Deleting your account removes your garden data as described in our Privacy Policy.

3. Subscriptions and Billing

The AI features (gardening advice, garden chat, and photo plant identification) require a paid, auto-renewing subscription, purchased through the Apple App Store or Google Play.

Pricing and Trial

• Monthly: $4.99 per month, with a 7-day free trial for eligible new subscribers.
• Yearly: $39.99 per year.

Prices are in U.S. dollars and may vary by region; the exact price is always shown at the point of purchase. Free-trial eligibility is determined by Apple or Google — if you have already used a trial, you will be charged when you subscribe.

Auto-Renewal and Cancellation

• Payment is charged to your Apple or Google account at confirmation of purchase (or when a free trial ends).
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your device's app store subscription settings (Settings → Apple ID → Subscriptions on iOS, or Google Play → Payments & subscriptions on Android). Canceling stops future renewals; you keep access until the end of the period you already paid for.
• Refunds are handled by Apple or Google under their policies; we cannot issue refunds for purchases made through their stores.

Fair Use

To keep the Service sustainable, AI features are subject to generous monthly usage allowances (for example, a set number of advice requests and plant identifications per calendar month). Current allowances are shown in the app when relevant. Allowances reset at the start of each calendar month (UTC). We may adjust allowances over time; material reductions will be communicated in the app.

4. AI Content Disclaimer

Gardening advice, chat responses, and plant identifications are generated by artificial intelligence. They are provided for general informational purposes only and may be incomplete or incorrect. In particular:

• Plant identifications may be wrong. Never eat, feed to animals, or handle a plant based solely on the app's identification — some plants are toxic, and misidentification can be dangerous.
• AI advice is not a substitute for professional horticultural, agricultural, medical, or veterinary advice.
• You are responsible for verifying any information before acting on it.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to bypass subscription checks, usage allowances, or other technical limits.
• Probe, scan, overload, or disrupt the Service or its infrastructure.
• Upload content that is unlawful, infringing, or harmful, or that contains malware.
• Reverse engineer the Service except where permitted by law.
• Resell or redistribute the Service or its AI outputs as a competing service.

We may suspend or terminate accounts that violate these Terms.

6. Your Content

You own the content you add to the Service (plant records, notes, and photos). You grant us a limited license to store, process, and display that content solely to operate and improve the Service — including sending relevant content to our AI provider when you use AI features, as described in the Privacy Policy. You are responsible for having the rights to any content you upload.

7. Our Intellectual Property

The Service — including the Nifty Norbot name, the Norbot character, artwork, software, and design — is owned by us or our licensors and protected by intellectual-property laws. These Terms grant you a personal, non-exclusive, non-transferable license to use the app for your own non-commercial gardening; they do not transfer any ownership to you.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. If we terminate without cause while you have an active paid subscription, your remedy is a pro-rated refund through the store where you purchased, subject to that store's policies.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate. Your plants remain your responsibility.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or plants, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of $50 or the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Apple App Store Terms

If you downloaded the app from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple; that Apple has no obligation to provide support for the app; and that Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them. Where these Terms are silent, Apple's standard Licensed Application End User License Agreement applies to your use of the app.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you through the Service. Continued use of the Service after a change indicates acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Washington, unless applicable law requires otherwise.
